Encroaching on hundreds of square meters of land to illegally build factories
Since 2021, people in Xuan Hoa village (Gia Xuan commune, Gia Vien district, Ninh Binh) have repeatedly sent petitions for help to authorities at all levels regarding noise and dust pollution from concrete production facilities of Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Investment and Trading Company Limited. However, up to now, this facility is still operating secretly, causing people to be upset, having to set up tents on the road to block vehicles carrying materials from entering and leaving.
Speaking to Lao Dong Newspaper, Mr. Ngo Hung Khanh - Vice Chairman of Gia Vien District People's Committee - said that regarding the reflection of Xuan Hoa village residents on the environmental pollution and noise from the above concrete production facility, the District People's Committee has established an inspection team. The inspection team determined that the above concrete production facility was built on an area of 1,100m2 of land (at plot number 1581, map sheet number 6) of Gia Xuan commune (Gia Vien district) signed a contract with the People's Committee of Gia Xuan commune to lease to Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Investment and Trading Company Limited since 2016.
"The above land area belongs to the type of rice land managed by the People's Committee of Gia Xuan commune and is not included in the concrete production planning. Mr. Nguyen Ngoc Ha (the land lessee) does not have an investment certificate, nor does he have a concrete production project approved by competent authorities. Therefore, the Gia Xuan Commune People's Committee's signing of a contract to lease 1,100m2 of land to Mr. Ha for leveling and renovating to make concrete production site is against the authority as prescribed" - Mr. Khanh said.
Although since 2021, Gia Xuan Commune People's Committee has terminated the land lease contract with Mr. Nguyen Ngoc Ha, he has not yet relocated the factory, equipment, machinery... to return the site to the commune for management. Mr. Ha even encroached on about 700m2 of land in the power grid corridor to expand concrete production.
Commune government is helpless?
Regarding Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Investment and Trading Company Limited - encroaching on land and building an illegal concrete production facility, since 2021, Gia Vien District People's Committee has issued many documents requesting Gia Xuan Commune People's Committee to handle and relocate this facility from residential areas. However, up to now, the facility is still operating secretly, causing people to be upset and have to set up tents on the road to prevent vehicles carrying materials from entering and leaving.
"We have repeatedly issued documents to the People's Committee of Gia Xuan commune to develop a plan to implement the remediation of violation consequences to ensure compliance with regulations. At the same time, Mr. Nguyen Ngoc Ha was required to stop concrete production activities on the above land and move machinery and materials elsewhere. However, the matter has not been completely resolved, causing public outrage" - Mr. Khanh shared.
On March 28, the People's Committee of Gia Xuan commune reported to the People's Committee of Gia Vien district about the handling of land violations by Mr. Nguyen Ngoc Ha's household.
The document stated: "Up to the present time, the People's Committee of Gia Xuan commune found that the incident has exceeded the functions and grassroots authority, due to lack of human resources, means and procedures for the coercive process. CPCs propose the District People's Committee and the specialized departments to guide the People's Committee of Gia Xuan Commune to the steps".
"In response to the proposal of Gia Xuan Commune People's Committee, we are assigning the district's functional departments to advise on a plan to completely handle the above incident" - Vice Chairman of Gia Vien District People's Committee Ngo Hung Khanh said.
