On April 5, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense has just received a petition from voters in Bac Kan province.
Accordingly, voters of Bac Kan province proposed to consider and amend the regulations and extend the time limit for fulfilling the obligations to participate in the militia and self -defense militia in Clause 2, Article 8 of the Law on Militia and Self -Defense Self -Defense Militia to 6 or 7 years to ensure the source of the obligation to participate in the local militia and self -defense militia.
Responding to this content, the Ministry of National Defense said that the Law on Militia and Self-Defense Forces No. 48/2019/QH14 was passed by the 14th National Assembly of the Socialist Republic of Vietnam, 8th session on November 22, 2019.
Article 8 of the Law on Militia and Self-Defense Forces stipulates that male citizens aged 18 to 45; female citizens aged 18 to 40 are obliged to participate in the Militia and Self-Defense Forces; if they volunteer to participate in the Militia and Self-Defense Forces, it can be extended to 50 years for men and 45 years for women.
The term of service for participating in the On-site Militia, Mobile Militia, Coast Guard Militia, Air Defense Militia, Artillery, reconnaissance, information, engineering, chemical defense, and medical is 4 years; the standing militia is 2 years.
Based on the requirements and military duties of the locality, agencies and organizations, the term of performing the obligation to participate in the Militia and Self-Defense Forces shall be extended but not exceeding 2 years; for marine militia, self-defense forces and militia and self-defense unit commanders shall be extended but not exceeding the age prescribed in Clause 1 of this Article.
The Chairman of the People's Committee of the commune, the Chairman of the district People's Committee where there is no administrative unit at the commune level, the head of the agency or organization decides to extend the age and time limit for fulfilling the obligations to participate in the militia and self -defense force as prescribed in this Article.
Thus, the 2019 Militia Law of Militia and Self -Defense Department has extended the time to participate in the militia and self -defense militia to suit the requirements of the tasks, the actual situation and ensure the source of the obligations to participate in the militia and self -defense force of the localities, ensuring social justice for young people to participate in militia and militia and military service.
