This is one of the most notable contents in the Draft Law on Cadres and Civil Servants, the latest amended, sent by the Ministry of Home Affairs to the Ministry of Justice for appraisal.
The draft revised Law consists of 8 chapters and 54 Articles, expected to be submitted to the National Assembly at the upcoming 9th session.
In the Draft Law, the Ministry of Home Affairs has proposed amending the regulations related to the recruitment, use and management of cadres and civil servants according to the job position to streamline the payroll, restructure and improve the quality of the contingent of cadres and civil servants in and after the process of arranging and streamlining the organizational structure of the political system.
Accordingly, the Ministry of Home Affairs clearly stated that the tasks that cadres and civil servants are not allowed to do related to public ethics include:
Avoiding responsibility, delegating assigned tasks; causing dispatch, disunity; arbitrarily abandoning work or participating in a strike.
Avoid and promote responsibility in implementing tasks and proposals for innovation and creativity.
Illegal use of State and People's assets.
Taking advantage of or abusing duties and powers; using information related to public duties for personal gain.
Discriminate treatment of ethnic groups, men and women, social groups, beliefs and religions in all forms.
According to the Ministry of Home Affairs, the draft law has added the content of "not avoiding or shirking responsibility in performing tasks and proposals for innovation and creativity" to overcome the situation of cadres and civil servants avoiding or shirking responsibility in performing tasks in the past.
In addition to the activities not specified in Article 19 of this Law, cadres and civil servants are not allowed to perform tasks related to production, business, personnel work specified in the Law on Anti-Corruption, the Law on Practicing Order, combating Wastefulness, the Law on State Secret Protection and other tasks as prescribed by law and by competent authorities.
According to the 2008 Law on Cadres and Civil Servants, supplemented by the Law on Cadres and Civil Servants and the 2019 amended Law on Public Employees, the things that cadres and civil servants are not allowed to do related to public ethics are as follows:
Avoiding responsibility, delegating assigned tasks; causing dispatch, disunity; arbitrarily quitting work or participating in a strike.
Illegal use of State and People's assets.
Taking advantage of or abusing duties and powers; using information related to public duties for personal gain.
Discrimination between ethnic groups, men and women, social groups, beliefs and religions in all forms.
